Section 96 Application

Property: Eastwood Shopping Centre, 160 - 188 Rowe Street, 196 Rowe Street and 7 - 9 Rutledge Street Eastwood

Applicant: Banna Developments

Concept drawing of Eastwood Shopping CentreBanna Developments lodged a Section 96 Application to Council in 2010 requesting amendments. The amendments include:

  • an increase of retail floor area from the approved 13,500m² to 13,600m²
  • an increase of commercial floor area from the approved 1,600m² to 2,200m²
  • a decrease of floor area for the restaurant from 1,700m² to 1,000m²
  • the addition of 15 residential units from the approved 195 units to a total of 210 residential units
  • an increase of 24 car parking spaces for the development.

The amendments will result in the addition of one extra storey for three of the four residential apartment buildings and adjustments to the building footprint and elevations of the residential towers. Design amendments are also proposed to the Trelawney Street vehicular ramp to reconstruct the access at grade.

Amendments are also proposed to various conditions of the development consent.

Voluntary Planning Agreement

A revised Voluntary Planning Agreement has also been lodged with the Section 96 application. Under Section 93F of the Environmental Planning and Assessment Act, developers may contribute works or money to the local community as part of their development. This revised Voluntary Planning Agreement sets out what contributions the developer intends to make to the local community.

Development Application for Eastwood Town Centre

Property: Eastwood Shopping Centre, 152-188 Rowe Street and 3-5 Rutledge Street, Eastwood

Applicant: Eastwood Centre Developments

Eastwood Centre Developments lodged a development application to Council in November 2007 to:

  • demolish the existing shopping centre and associated car parking structures
  • have a staged construction of a mixed commercial and residential development.

The main components of the development are:

  • 13,500m2 of net useable retail floor area, over two levels
  • 1,600m2 of net useable commercial floor area (not including the restaurant and childcare centre as given below)
  • 1,700m2 of net useable floor area for a restaurant
  • 800m2 of net useable floor area for a childcare centre
  • A total of 970 car parking spaces, 676 of which are associated with the proposed retail/commercial uses and 294 with the proposed residential units.

Council granted consent on February 2009.
