On 5 May 2009 Council resolved that Draft Ryde LEP 2008 be adopted and that the amended Plan be forwarded to the Department of Planning under Section 68 of the EP&A Act 1979 requesting the Minister make the Plan.
On 16 June 2009, Council resolved to adopt with amendment the following Draft Development Control Plans (DCPs):
- Ryde Development Control Plan 2008
- Ryde Development Control Plan: Gladesville Town Centre and Victoria Road Corridor.
Ryde Development Control Plan 2008 is to come into effect upon the gazettal of Ryde Local Environmental Plan (LEP) 2008.

In recent years the State Government has initiated a number of reforms to the NSW planning system. One of these reforms was the introduction of a Standard for Local Environmental Plans (LEPs).
The Standard LEP sets out the standard form and content for all new LEPs and its aim is to achieve standardisation and consistency for Local Environmental Plans throughout NSW.
Draft Ryde LEP 2008 is a consolidating LEP that represents Stage 1 of a three stage strategic framework for the city to update and improve our local planning controls. It will update City of Ryde planning controls and bring them in line with State Government requirements.
Stage 2 of the process will involve undertaking a Local Strategy that will establish the planning direction for the City up to 2031 and Stage 3 will entail development of a comprehensive plan to guide the City of Ryde through to 2031.
The consolidating LEP, known as Draft Ryde LEP 2008, is a ‘like for like’ transfer of information from the current Ryde Planning Scheme Ordinance and where necessary development standards contained in Development Control Plan 2006 into the Standard LEP .
The transfer of information has not been able to be identical because of the constraints imposed by the Standard LEP. As a result Draft Ryde LEP 2008 comprises new zones, definitions and clauses and is in a different format to the Ryde Planning Scheme.
Draft Ryde Local Environmental Plan 2008
The City of Ryde has prepared a new Draft Local Environmental Plan. The community is invited to consider the Plan and make comments and submissions on it before any decision is made as to whether it should be adopted.
What is a Local Environmental Plan (LEP)?
A Local Environmental Plan is a document of words and maps which sets out the legal standards or requirements for development in our city.
What is the "Standard LEP"?
As a result of a number of reforms by the State Government aimed at simplifying the planning system, a standard LEP was developed by the Department of Planning. The Standard LEP provides a format for the preparation of LEPs by all Councils in NSW. The Standard LEP specifies land use zones, uses that maybe to be permitted within those zones, planning provisions and definitions. All new Local Environmental Plans must be in that format.
What is the purpose of Draft Ryde Local Environmental Plan 2008?
Draft Ryde LEP 2008 is anLEP that takes the provisions of the Ryde Planning Scheme Ordinance and where necessary development standards contained in Development Control Plan 2006, and within the constraints of the Standard LEP, makes as close as possible a ‘like for like’ transfer of those provisions into the Standard LEP.
However some variations occur due to:
- updating and correcting of information.
- changes in definitions under the Standard LEP.
- compulsory uses and types of zones under the Standard LEP which the city must adopt.
Specific examples of these variations include:
- Zoning changes based on correction of drafting errors and anomalies in the current Ryde Planning Scheme Ordinance.
- Zoning changes based on updated information from the Department of Planning, the Roads and Traffic Authority and National Parks and Wildlife Service.
- Zoning of parks under Council’s care control and management to open space.
- Zoning changes to Curzon Hall at 53 Agincourt Road Marsfield, properties 589 – 621 Victoria Road Ryde and some properties around the perimeter of Ryde Hospital in accordance with the requirements of the Standard LEP.
- Height controls for the West Parade, Trelawney, Rutledge and Rowe Streets Eastwood street block being amended as a result of the transfer of controls from existing Development Control Plans.
- Inclusion of 95 Bowden Street Meadowbank as a Heritage Item.
- Floor space ratio controls for properties 307 Lane Cove Road and 36 – 58 Delhi Road Macquarie Park.
- Variation to height in Ryde Town Centre being prohibited only in Precinct 2 Town Core.
Where does Draft Ryde LEP 2008 apply?
The Draft LEP applies to all land within the City of Ryde Local Government Area with the exception of lands identified as "Deferred Matter" on Draft Ryde Local Environmental Plan 2008 Land Application Map, such as Gladesville Town Centre and certain sites in Macquarie Park owned by the State Government.
