 Draft Ryde Local Environmental Plan 2008 
 Section 68 Report - Department of Planning

 


On 5 May 2009 Council resolved that Draft Ryde LEP 2008 be adopted and that the amended Plan be forwarded to the Department of Planning under Section 68 of the EP&A Act 1979 requesting the Minister make the Plan.

Summary of all proposed changes to the written document (Attachment 8A) and maps (Attachment 8B) and basis for the change. It should be noted that the Department forwarded Council an electronic copy (PDF format) of Draft Ryde Local Environmental Plan 2008 as prepared by Parliamentary Counsel (ref: e2007-050-37.d08 24 July 2008) with the Section 65 Certificate. It is this version of the draft Plan that Attachment 8A - summary of changes to Ryde LEP 2008 written document relates to. The Department of Planning advised on the 24 July 2009 that Parliamentary Counsel would carry out the necessary amendments to the written document.

Draft Ryde LEP 2008 as exhibited. Required amendments are as specified in Attachment 8. Note: The Department of Planning advised Council on the 5 September 2008 that the land use for all zones except SP2 zones should be amended prior to exhibition to include signage.

Attachment 10
On 5 May Council resolved with regard to the draft Plan that all land categorised as bushland under Section 36 of the Local Government Act, 1993 be zoned E2 Environmental Conservation. LEP 2008 Land Zoning Map has been amended accordingly. Council further resolved that the E2 zoning be supported by the outcomes of the Environmental Studies being conducted as part of the City of Ryde Local Strategy.

Mr Arthur White from Biosphere Environmental Consultants was engaged by Council in May 2009 to review all land categorised wholly or in part as bushland under Council's Plans of Management. Mr White has assessed each area for its suitability to be zoned E2 Environmental Conservation. Mr White was directed to take into consideration the Department of Planning's LEP practice note PN09-002.

Land categorised as bushland under Section 36 of the Local Government Act 1993 is provided below in maps and aerial photographs.
