Section 94 Contributions Plan

Section 94 of the Environmental Planning and Assessment Act 1979 enables Councils to levy contributions for public amenities and services as a consequence of development.

The Act and the Act's Regulations require Council to prepare a Contributions Plan, if Council intends to levy any contributions under the terms of the Act, and make Council publicly accountable for the use and administration of contributions it receives.

Council's Section 94 Development Contributions Plan applies to all land within the Ryde local government area.

Amendments to the Plan have been made to capture complying development and residential development types introduced by the Affordable Rental Housing State Environmental Planning Policy (SEPP) 2009. The amended plan came into effect on 16 March 2011.

An administrative amendment prepared under Clause 32(3) of the Environmental Planning and Assessment Regulation 2000 applies a revised base value to the Consumer Price Index (CPI) that existed when the contributions plan came into effect. The Australian Bureau of Statistics (ABS) adjusted the base rate for the CPI effective from the September 2012 quarter. This amendment ensures that contributions can continue to be indexed using the CPI published by the ABS each quarter. This amendment came into effect on 23 January 2013.

The S94 Development Contributions Plan 2007, made effective on 19 December 2007, has been reviewed and updated. The objectives of the Plan have not changed and the minor modifications are designed to make it easier for potential developers to understand how the Plan works in relation to their projects. The opportunity has also been taken to acknowledge regulatory changes made by the State since the Plan was introduced. There are no changes to the areas to which the Plan applies.

The modified Plan, Section 94 Development Contribution Plan 2007 Interim Update (2014), is effective from 10 December 2014, see below.

Purpose of the Plan

The purpose of the plan is to provide the necessary framework for the efficient and equitable determination, collection and management of developer contributions towards the provision of public amenities and services such as:

  • Community and cultural facilities
  • Open space and recreation facilities
  • Civic and urban improvements
  • Roads and traffic management
  • Transport and accessibility
  • Stormwater management.

The provision of such services and amenities is to be undertaken to ensure that appropriate and reasonable environmental, amenity and servicing standards are achieved throughout the City. The plan also provides that the facilities are designed and constructed to a standard that is proportionate with the needs of both the existing and future population that will utilise them.
