VOLUNTARY PLANNING AGREEMENT

Notice of Exhibition of Voluntary Planning Agreement under Section 7.4 of the Environmental Planning and Assessment Act 1979

Council proposes to enter into the following Deed of Variation to a Voluntary Planning Agreement, which is now on Public Exhibition:

Deed of Variation for North Ryde M2 Site Planning Agreement (Deed) related to Lots 114, 115, 116 and 117 in Deposited Plan 1224238 (Site).

Description: The Original Planning Agreement allocated $8.5 million in s7.11 contributions credit to Lots 115 and 116. The Deed amends to the Planning Agreement by clarifying how the $8.5 million in credits is allocated to Lots 115 and 116. Lots 115 and 116 under the Deed will be both allocated $4.25 million in credits each.

The purpose of this amendment is to ensure clarity for Council, current and future owners of Lots 115 and 116 when s7.11 credits are to be applied to future development via the Planning Agreement.
