Voluntary Planning Agreements Register

Planning Agreements are a legally binding contract between a planning authority (City of Ryde) and a developer made under Section 93F of the Environmental Planning and Assessment Act 1979 (EPA Act).

Planning Agreements generally require a developer to dedicate land free of cost, pay a monetary contribution or provide any other material for public benefit to be used for public infrastructure or another public purpose. 

Clause 206 of the Environmental Planning and Assessment Regulation 2021 (EPA Reg) requires Council to keep a Voluntary Planning Agreement (VPA) Register available free of cost to the public. Find out more about Voluntary Planning Agreements.

The Developer will be providing approximately $9.5 million in access roads towards the Macquarie Park Access Network as public benefits, in accordance with Clause 6.9 of the Ryde Local Environmental Plan 2014.

A Deed of Amendment was entered into by the Parties on 13 February 2020 to resolve Road 14 and Waterloo Road Intersection Construction issues. The Deed of variation involves a temporary access being provided for Road 14 until 30 June 2021, whilst construction of the final intersection is undertaken. This will allow occupation of Building C as originally anticipated. John Holland has provided Council with a $4.8 million bank guarantee for the restoration of the temporary access road and intersection.

  • 11.49.4m² of retail space;
  • 3,629.6m² of commercial space (including office, gym and medical centre);
  • 409 residential apartments consisting of 97 x 1 bedroom, 249 x 2 bedroom and 63 x 3 bedroom apartments;
  • 4 levels of basement car parking accommodating 1,035 vehicles;

The above development application is to be determined by the Sydney North Planning Panel in the near future, which will require the Developer to enter into a Voluntary Planning Agreement with Council prior to the consent becoming operational. The VPA provides the following Public Benefits:

  • Redevelopment of Eastwood Plaza (Rowe Street) to value of no less than $5.06M
  • 5 x 1 bedroom affordable housing apartments to the value to no less than $3.90M
  • Civic and urban improvements as Works-In-Kind in surrounding streets (other than Eastwood Plaza) to value of no less than $4.25M

The Deed of Variation provides for an additional public benefit through the dedication of land subject to an existing footpath and road reserve; and a consequential reduction in the value of the monetary contribution to be paid under the Planning Agreement.
